The good news is that Governor Jerry Brown recently signed three new ADU-related bills into law, in the hopes of alleviating California’s housing crisis. These new legislation may make it easier for California homeowners to obtain permits for new ADUs from city and county authorities.

Homeowners in California should be aware of the following legislation that affects ADU construction:

  • Senate Bill (SB) 1069—Reduces, and in certain circumstances eliminates, the requirements for ADU parking and utility hook-up fees. This measure also makes it easier to get clearance for ADUs that are attached to the main house.
  • Assembly Bill 2299—Makes it mandatory for local ADU ordinances to provide non-discretionary and ministerial permission for second-unit construction that meets city building codes.
  • Assembly Bill 2406—Makes it easier for homeowners who want to convert an existing room in their home into an attached ADU, such as a studio apartment, to get permits.

These regulations were enacted to prevent local governments from slowing down the process for homeowners who want to build ADUs by limiting city and county power over state law. As of January 1, 2017, all local governments were required to enact ADU ordinances that met these new state requirements.

Even better, the new California state laws will assist speed up the approval process for ADU development by removing the cost of secondary utility hook-up, which is generally borne by the property owner. In terms of parking requirements, state legislation eliminates them for ADUs located near public transportation lines and reduces them in other regions.
